Terms of Use for WrestleStat.com

These Terms of Use ("Terms") govern your access to and use of https://www.wrestlestat.com and all related content, features, rankings, statistics, tools, fantasy games, subscriptions, and applications provided by WrestleStat ACS, LLC ("WrestleStat," "we," "our," or "us") (collectively, the "Services").

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

1. Eligibility and Accounts

You must be at least 18 years old, or the age of majority in your jurisdiction, to create an account. By creating an account, you represent that the information you provide is accurate, complete, and current.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at support@wrestlestat.com if you suspect unauthorized use of your account.

One person per account. Accounts (including Premium access) may not be shared, sold, transferred, or loaned to any other person or entity. You may not disclose or share your username or password with anyone. We may limit concurrent sessions and may suspend, revoke active sessions, or terminate accounts we believe are being shared or used in violation of these Terms.

2. Subscriptions and Premium Access

Certain features of the Services require a paid subscription ("Premium"). Subscription plans, pricing, eligibility windows, and any plan restrictions are displayed at the time of purchase. Some plans may be limited-time or restricted to specific users or cohorts.

Premium includes access to certain features such as Fantasy College Wrestling (FCW). The specific features included in Premium may change prospectively.

Auto-renewal. Premium plans purchased through our payment provider (currently PayPal) generally auto-renew at the end of each billing period unless you cancel. You can cancel at any time before the renewal date to prevent further charges. Access typically continues through the end of the current paid period.

Cancellations and refunds. You may cancel future renewals at any time (for PayPal, via your PayPal account’s automatic payments settings) or by contacting support@wrestlestat.com. Except as required by law, subscription fees are non-refundable and we do not provide pro-rated refunds for partial periods.

Billing issues. If a payment fails or a subscription lapses, Premium access may pause or end until payment is resolved. We may change subscription pricing or included features prospectively upon notice.

We reserve the right to suspend or terminate Premium access for any account associated with a violation of these Terms, including the restrictions in Section 4.

3. License to Use the Services

Subject to your compliance with these Terms, WrestleStat grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your own personal, non-commercial informational use, viewed through a standard web browser or our authorized applications.

No other right, title, or interest in the Services, or in the underlying content, data, or software, is granted to you. All rights not expressly granted are reserved by WrestleStat.

4. Prohibited Conduct — No Scraping, Crawling, or Automated Data Extraction

WrestleStat's rankings, statistics, and compiled data are the product of substantial time, investment, and proprietary methodology. Unauthorized automated collection of this data is strictly prohibited and is treated as a serious violation of these Terms. Except as expressly permitted in writing by WrestleStat or through a documented, authorized API subject to a separate agreement, you may NOT, and may not permit or assist any third party or automated agent to:

  • use any robot, spider, crawler, scraper, harvester, or other automated device, process, or means to access, monitor, copy, index, extract, or collect any content, data, statistics, rankings, or other materials from the Services, in whole or in part, by any means;
  • circumvent, disable, bypass, or interfere with rate limiting, request throttling, CAPTCHAs, authentication mechanisms, bot detection, IP or account blocking, robots.txt directives, or any other technical measure used to control or restrict access to the Services;
  • use rotating IP addresses, proxy or VPN networks, headless browsers, browser automation, or falsified request headers or user-agent strings for the purpose of disguising automated access as human use or evading detection or blocking;
  • access the Services through any interface other than the interfaces we expressly provide, including by reverse engineering, decompiling, or probing any API, endpoint, or network request used by the Services in order to extract data programmatically;
  • systematically download, mirror, replicate, cache, or otherwise reproduce a substantial portion of the Services' database, rankings, statistics, or content, whether for personal, research, commercial, or any other purpose;
  • use any data obtained from the Services, directly or indirectly, to build, train, populate, or maintain a competing product, database, dataset, ranking system, or service, or to train a machine-learning or artificial-intelligence model;
  • resell, sublicense, publish, redistribute, or commercially exploit any content or data obtained from the Services without WrestleStat's prior written consent; or
  • use any tool or technique to place an unreasonable or disproportionate load on our servers or infrastructure, including automated or bulk requests that exceed the volume of ordinary interactive human browsing.

These restrictions apply regardless of whether the content or data accessed is otherwise publicly viewable on the Services. Public visibility of a page does not grant a license to extract, copy, or reuse its contents outside the scope of ordinary personal browsing.

WrestleStat actively monitors for and employs technical measures to detect and prevent scraping and automated abuse, including rate limiting, bot detection, and IP and account blocking. We reserve the right, without prior notice, to throttle, block, suspend, or permanently terminate access for any user, account, IP address, or network that we believe, in our sole discretion, is engaged in conduct prohibited by this Section.

A violation of this Section may constitute unauthorized access under the Computer Fraud and Abuse Act and analogous state and international computer-crime, anti-scraping, and unfair-competition laws, in addition to a breach of this contract. WrestleStat reserves the right to pursue all available legal and equitable remedies for a violation of this Section, including injunctive relief and recovery of damages, costs, and attorneys' fees.

If you wish to license WrestleStat data for a research, commercial, or other bulk use, contact support@wrestlestat.com to request a separate written data license agreement. No such license is granted by your use of, or access to, the Services absent a signed agreement. Programmatic/API access is permitted only with our written permission and a valid API credential; otherwise, automated access is prohibited. Search-engine crawlers are allowed only as permitted by our robots.txt.

5. Other Prohibited Conduct

In addition to Section 4, you agree not to:

  • use the Services for any unlawful purpose or in violation of any applicable local, state, national, or international law;
  • impersonate any person or entity, or misrepresent your affiliation with any person or entity;
  • use a username that infringes the rights of another person or entity, or is offensive, vulgar, or obscene;
  • upload or transmit any virus, malware, or other harmful code;
  • interfere with or disrupt the integrity or performance of the Services or the data contained within them;
  • attempt to gain unauthorized access to the Services, other accounts, or connected computer systems or networks; or
  • use the Services to harass, abuse, or harm another person.

6. Fantasy Wrestling and Contests

The Services may offer fantasy wrestling games, pick'em contests, tournament pools, or similar features ("Contests"). Contests are offered for entertainment purposes only and are not gambling. Fantasy College Wrestling (FCW) is available to accounts with an active Premium subscription (or qualifying plan). Access to FCW ends or may be paused if your Premium subscription lapses or is terminated; Premium subscription fees and refunds are governed by Section 2. Where a Contest involves an entry fee or prize, participation is governed by any additional rules posted for that Contest, and you are solely responsible for determining whether your participation is lawful in your jurisdiction. Other fantasy or contest products (for example, NCAA Fantasy) may be offered as a separate paid service; any fees, entry fees, prizes, and refund terms will be disclosed at the time of purchase or in that product’s posted rules.

7. User Content

If the Services allow you to submit content such as picks, comments, profile information, or forum posts ("User Content"), you retain ownership of your User Content but grant WrestleStat a worldwide, non-exclusive, royalty-free license to host, display, reproduce, and distribute it in connection with operating and promoting the Services. You are solely responsible for your User Content and represent that it does not violate any law or third-party right.

We may remove or disable access to any User Content, and may suspend or terminate accounts, at our discretion, including to enforce forum rules and to address reports of prohibited content.

8. Intellectual Property

The Services and their original content, features, functionality, compiled statistics, rankings, and underlying database are and will remain the exclusive property of WrestleStat and its licensors. The Services are protected by copyright, trademark, trade secret, and other laws of the United States and other countries. Our trademarks, trade dress, and logos may not be used without our prior written consent. Third-party marks and data remain the property of their respective owners. WrestleStat is not affiliated with the NCAA, universities, or conferences unless expressly stated.

9. Third-Party Links and Services; Ads

The Services may contain links to third-party websites or services that are not owned or controlled by WrestleStat. We have no control over, and assume no responsibility for, the content, privacy practices, or policies of any third-party websites or services. We encourage you to review the terms and privacy policies of any third-party site you visit.

The Services may display third-party advertising or sponsorships. Advertising partners are subject to their own policies and may use cookies or similar technologies as described in our Privacy Policy.

10. Privacy

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and disclose information.

11. Disclaimer of Warranties

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WrestleStat does not warrant that the Services will be uninterrupted, secure, error-free, or that rankings, statistics, or other data will be accurate or complete at all times.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WRESTLESTAT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR ACCESS TO OR USE OF, OR INABILITY TO ACCESS OR USE, THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

13. Indemnification

You agree to defend, indemnify, and hold harmless WrestleStat and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Services, your violation of these Terms, or your violation of any third-party right.

14. Monitoring and Enforcement

We monitor usage to protect the Services and users, including detecting scraping and abusive behavior. We may rate limit requests, throttle responses, challenge requests, block IPs, revoke sessions, or suspend/terminate accounts at our discretion to enforce these Terms. We may seek injunctive or other equitable relief for actual or threatened violations.

15. Termination

We may suspend or terminate your account and access to the Services at any time, without prior notice or liability, for any reason, including a breach of these Terms. Upon termination, your right to use the Services will immediately cease. Sections of these Terms that by their nature should survive termination, including Sections 4, 8, 10, 11, and 12, will survive.

16. Governing Law

These Terms are governed by the laws of the State of Iowa, United States, without regard to its conflict-of-law provisions. Any dispute arising from these Terms or the Services will be subject to the exclusive jurisdiction of the state and federal courts located in Iowa, and you consent to personal jurisdiction there.

17. Changes to These Terms

We may modify these Terms at any time. If we make a material change, we will provide notice by posting the updated Terms on this page and updating the "Last Updated" date above. Your continued use of the Services after a revision becomes effective constitutes acceptance of the revised Terms.

18. Miscellaneous

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full effect. Our failure to enforce any right or provision will not be deemed a waiver of that right. These Terms constitute the entire agreement between you and WrestleStat regarding the Services and supersede any prior agreements.
